These Terms & Conditions (“Terms”) govern your access to and use of https://forgefire.co (the “Site”) and any of our mobile or desktop applications (each an “App”, and together with the Site, the “Services”), operated by Forgefire Technologies LLP (“Forgefire”, “we”, “us” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services. An individual App may also present additional, App-specific terms; where there is a conflict, the App-specific terms govern for that App.
1. About us
Forgefire Technologies LLP is a Limited Liability Partnership incorporated and registered in India. We design and build software products and applications across a range of consumer and professional categories.
2. Eligibility
You must be at least 18 years of age and capable of forming a binding contract under the Indian Contract Act, 1872 to use the Services. By using the Services, you represent and warrant that you meet these requirements.
3. Our Services
The Site provides information about Forgefire and the ability to join a waitlist or contact us. Our Apps are software applications we make available for download through third-party app stores. Any products, features, timelines, or descriptions are provided for general information only, may be incomplete or change, and do not constitute a commitment to develop, launch, or continue any product or service. Joining a waitlist does not create any right to access, or obligation on us to provide, any product or service.
4. Licence to use the Services
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Site for your personal, informational purposes, and to install and use one copy of each App on a device that you own or control, solely for your own use. You agree not to:
- Use the Services in violation of any applicable law or regulation.
- Copy, reproduce, distribute, sell, rent, sublicense, or create derivative works from the Services or their content without our prior written consent.
- Reverse engineer, decompile, or disassemble any App, or attempt to derive its source code, except to the extent this restriction is prohibited by applicable law.
- Interfere with, disrupt, probe, or attempt to gain unauthorised access to the Services, their servers, or related systems or networks.
- Use any automated means to access or scrape the Services except as permitted by our robots directives.
- Submit false, misleading, infringing, unlawful, or harmful content.
5. App stores and third-party platforms
You obtain our Apps through third-party app stores (such as the Apple App Store or Google Play), and your download and use is also subject to that store’s terms. With respect to any App obtained through the Apple App Store: these Terms are between you and Forgefire only, and not with Apple; Apple has no obligation to provide maintenance or support for the App; to the maximum extent permitted by law, Apple has no warranty obligation and is not responsible for addressing any claims relating to the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a jurisdiction subject to an applicable embargo and are not on any restricted-party list, and you agree to comply with all applicable third-party platform terms.
6. Communications
If you provide your email address, you consent to receive communications from us, such as product updates and early-access invitations. You can opt out at any time using the unsubscribe mechanism provided or by contacting us. Your information is handled in accordance with our Privacy Policy.
7. Intellectual property
The Services and all content, design, text, graphics, logos, trademarks, and software are owned by or licensed to Forgefire Technologies LLP and are protected by applicable intellectual property laws. The “Forgefire” name and marks are our property. Except for the limited licence above, no rights are granted to you in respect of any of our intellectual property.
8. No professional advice; informational outputs
Content, recommendations, calculations, forecasts, and other outputs provided through the Services are for general informational purposes only and are not professional advice. Nothing in the Services constitutes medical, health, clinical, diagnostic, travel, legal, financial, or other professional advice, and it is not a substitute for advice from a qualified professional. Outputs may be incomplete or inaccurate, may rely on third-party data that can be unavailable, delayed, or wrong, and should not be relied upon as the sole basis for any decision. You use them at your own discretion and risk, and should seek the advice of a qualified professional with any questions you may have.
9. Third-party services and links
The Services may use or contact third-party services (such as form, hosting, analytics, mapping, geocoding, weather, and content-delivery providers) and may link to third-party websites. We do not control and are not responsible for third-party content, services, data, or practices, and your use of them is at your own risk and subject to their terms.
10. Disclaimer of warranties
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any output or data obtained through them will be accurate or reliable.
11. Limitation of liability
To the maximum extent permitted by applicable law, Forgefire Technologies LLP, its partners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Services. To the extent liability cannot be excluded, our aggregate liability shall be limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Forgefire Technologies LLPand its partners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services or your breach of these Terms or applicable law.
13. Changes to the Services and Terms
We may modify, suspend, or discontinue the Services (in whole or in part) at any time without notice. We may also revise these Terms from time to time; the “Effective date” above indicates when the current version took effect. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
14. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles. Subject to the dispute-resolution provision below, the courts at Pune, Maharashtra, India shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or the Services.
15. Dispute resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall, as far as possible, be resolved amicably. Where a dispute cannot be resolved amicably, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Pune, Maharashtra, India, and the proceedings shall be conducted in English.
16. General
- Severability — if any provision is held invalid or unenforceable, the remaining provisions will continue in full force.
- Waiver — our failure to enforce any right or provision is not a waiver of that right or provision.
- Entire agreement — these Terms, together with the Privacy Policy and any App-specific terms, constitute the entire agreement between you and us regarding the Services.
- Assignment — you may not assign these Terms without our prior written consent; we may assign them in connection with a business transfer.
